Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.
To exercise the right of withdrawal, you must inform us (Electric Bike Solutions GmbH, Carl-Bosch-Straße 2, 69115 Heidelberg, e-mail info@e-lastenrad.de, telephone +49 6221 8710687) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier.
We will collect the goods. You shall bear the direct costs of returning the goods. These costs amount to EUR 200 for two-wheeled cargo bikes and EUR 250 for three-wheeled cargo bikes.
You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.
End of the instruction on the right of withdrawal
4.2 Exceptions to the right of withdrawal:
Pursuant to Section 312d Paragraph 2 of the German Civil Code (BGB), unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts:
- contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
- contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
- contracts for the supply of goods if, after delivery, they have been inseparably mixed with other goods due to their nature,
- contracts for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery,
- contracts for the supply of newspapers, periodicals, or magazines, with the exception of subscription contracts,
- contracts concluded within the framework of a form of marketing in which the trader offers goods or services to consumers who are personally present or are granted the opportunity to be so, specifically in a transparent procedure conducted by an auctioneer based on competitive bids, in which the successful bidder is obliged to purchase the goods or services (publicly accessible auction),
- contracts in which the consumer has expressly requested the trader to visit him to carry out urgent repair or maintenance work; this does not apply to other services performed during the visit that the consumer did not expressly request, or to goods supplied during the visit that are not strictly necessary as spare parts for the maintenance or repair,
